Seller's commitment. Fotocolombo S.r.l. (“Fotocolombo”) has been on the online sales market since 2001 and, in addition to its commitment to finding the best offer for the customer in terms of quality and price, it is always oriented towards improving the service offered, in the name of punctuality, transparency and correctness.
Object of the contract, type of products and recipients of the service. Through the website reachable at the URL https://www.fotocolombo.it and https://www.bicicolombo.it and the related e-commerce platform (“Online Store”), Fotocolombo markets and sells both online and in the physical store in Merate in Viale Verdi, 95: photographic products (such as cameras, mirrorless cameras, photo printers, tripods, monitors, backpacks, memory cards and accessories from the world of photography) and cycling products (such as electric bicycles, helmets, pedals and accessories from the world of cycling) (“Products”). The Customers of the Online Store (“Customer/s”) may be final consumers (B2C sales channel, “Consumer/s”) or subjects with a VAT number (B2B sales channel), including, for example, professionals and professional firms, businesses, individual firms, traders.
Scope of application and contractual documents. The published Conditions, made available for consultation and download from the Online Store, apply to all purchase contracts concluded by Customers through the Online Store or through electronic correspondence (“Contract/s”), with prevalence over any other agreement. Each Contract is therefore governed by (i) the Conditions and (ii) the order placed through the Online Store, if and as confirmed by Sferatrade.
Personal data. With regard to the regulation on the processing of personal data, please refer, respectively, to the Privacy Policy and the Cookies Policy published on the Online Store.
Registration. Customers who intend to purchase the Products must register on the Online Store to obtain an access account to the reserved area (“Reserved Area”), from which they can manage and check the status of orders and (where applicable) modify the data entered (such as name, surname, company name, shipping and email address, headquarters, telephone numbers, payment and billing data).
Sending and confirming the order. Conclusion of the Contract. After registering, the Customer accesses the Reserved Area and places the order: (i) by choosing the Products available in the catalogue and adding them to the virtual cart, (ii) by paying the price (including taxes and shipping costs) according to the available methods and (iii) by sending the order following the instructions on the Online Store. The Contract is considered concluded when Fotocolombo sends the order confirmation to the Customer, with the payment of the Products by the latter.
Shipping and delivery. The time of shipping of the Products depends on the payment method chosen by the Customer. Therefore, if (i) the payment of the price occurs at the same time as the order is sent (for example, by credit or debit card or through payment intermediaries) the shipment is entrusted as soon as possible to a trusted courier and the delivery to the Customer occurs in accordance with the times indicated on the sheet of each individual Product (in consideration of the Product purchased); (ii) the payment is made by advance bank transfer to the coordinates communicated on the Online Store, the shipment is made once the credit has been received. The delivery times and the specific times communicated by the courier are always indicative, and in any case respect the limit of 30 (thirty) days provided for Consumers, except in cases of force majeure.
Cancellation of the order of the non-consumer Customer. Effects. Without prejudice to the provisions of the previous point, in a completely exceptional manner, Fotocolombo applies the following order cancellation policy: (i) if the non-consumer Customer cancels the order within 24 (twenty-four) hours from the moment Fotocolombo receives the payment for the Products, Fotocolombo will fully refund the amount paid, including shipping costs; (ii) if the non-consumer Customer, after the deadline referred to in point (i), cancels the order after receiving the shipping notification, Fotocolombo will retain a penalty equal to 20% (twenty percent) of the total amount paid by the non-consumer Customer, as order management costs; (iii) The communication with the request to cancel the order must be made in writing via email to fotocolombo@gmail.com, to the PEC fotocolombosrl@pec.it specifying the order number.
